Terms & Conditions
The terms governing the use of the Etisalna website, the Klamna platform and our services.
1. Definitions
"Company", "we": Hala Etisalna Company (Etisalna), Riyadh. "Platform": Klamna, its apps and APIs. "Customer": the contracting organisation and its authorised users. "Customer Data": contacts, chats, recordings and files processed on the Platform.
2. Acceptance
By using etisalna.sa or the Platform you accept these terms and our Privacy Policy. A signed agreement or quote prevails where it conflicts.
3. Services
Cloud PBX, contact centre, WhatsApp API, omnichannel messaging, AI, CRM and invoicing as per the agreed plan. We may improve features without reducing the core contracted service.
4. Accounts
Provide accurate information, protect credentials, enable two-factor authentication and notify us of any unauthorised use. You are responsible for your users' activity.
5. Acceptable use
No spam or unsolicited messages or calls, nothing unlawful in the Kingdom or contrary to CST regulations or Meta/WhatsApp policies, no fraud, impersonation or offensive content, and no attempts to breach or disrupt the Platform.
6. Numbers, calls and WhatsApp
Numbers follow licensed carriers' rules. Inform callers when recording where required. WhatsApp use follows Meta policies and pricing. Obtain opt-in before marketing messages and offer an opt-out.
7. Fees and billing
Fees follow the quote or plan plus VAT, with e-invoices per ZATCA requirements. Service may be suspended for overdue payment after notice. Fees for used periods are non-refundable unless agreed otherwise.
8. Customer data
Customer Data remains the Customer's; we process it only to provide the service, store it in the Kingdom, keep it confidential and allow export at the end of the contract before deletion.
9. Intellectual property
The Platform and trademarks belong to the Company or its licensors. Customers receive a non-exclusive, non-transferable licence for the subscription term.
10. Third-party services
Integrations (Meta, carriers, stores, CRMs) are governed by their own terms; we are not responsible for their outages or policy changes.
11. Service and support
We aim for high availability and provide support through published channels during business hours, with advance notice of planned maintenance where possible.
12. Liability
To the extent permitted by law we are not liable for indirect or consequential loss or lost profits, and total liability is capped at the fees paid in the twelve months before the claim.
13. Suspension and termination
We may suspend accounts for acceptable-use breaches or at an authority's request. Either party may terminate per the agreement's notice period; outstanding fees remain due.
14. Governing law
Saudi law governs these terms; the competent courts in Riyadh have jurisdiction, after an attempt at amicable settlement.
15. Changes and contact
We may update these terms and publish them here. Contact: info@etisalna.sa · 920031338.
